These Terms of Service ("Terms") govern the purchase and use of the MetaAds Agent digital product ("Product") available at tonyabel.com/metaads-agent.
By purchasing the Product, the buyer ("Buyer") agrees to be bound by these Terms.

MetaAds Agent is a digital product consisting of Python source code files, configuration files, documentation (including SKILL.md, workflows, and README), and supporting materials designed to assist with Meta (Facebook & Instagram) advertising campaign management using AI coding tools.
The Product is delivered as a complete package of source files. It is not a SaaS subscription — the Buyer receives full ownership of the source code upon purchase. The Product is designed to work with any AI coding tool that can read instruction files, run terminal commands, and follow structured rules.
Upon purchase, the Buyer is granted a non-exclusive, non-transferable, perpetual license to:

Breach of license terms entitles the Seller to terminate the license and pursue legal remedies.
The Product is digital content that is not supplied on a tangible medium. In accordance with Article 38 point 13 of the Polish Act of 30 May 2014 on Consumer Rights (Ustawa z dnia 30 maja 2014 r. o prawach konsumenta, Dz.U. 2014 poz. 827):
The Buyer who is a consumer acknowledges that by purchasing and receiving immediate access to the Product (digital content), the Buyer expressly consents to the performance of the contract before the expiry of the 14-day withdrawal period and acknowledges that this constitutes a waiver of the right of withdrawal.
Accordingly, no refunds are provided after delivery of the digital content.
This provision is presented clearly and requires explicit consent during the purchase process, in compliance with Article 21(2) of the Consumer Rights Act.
The Product, including all source code, documentation, algorithms, optimization rules, and design, is the intellectual property of the Seller, protected under the Polish Act of 4 February 1994 on Copyright and Related Rights (Ustawa o prawie autorskim i prawach pokrewnych, Dz.U. 1994 nr 24 poz. 83).
The purchase grants the Buyer a usage license as described in Section 6 but does not transfer copyright or other intellectual property rights to the Buyer.
The Product is provided "as-is" (bez gwarancji). The Seller does not guarantee:
The Buyer acknowledges that results depend on many factors outside the Product's control, including but not limited to the advertising budget, creative quality, target audience, market conditions, and Meta platform changes.
Nothing in this section limits the Buyer's statutory rights regarding defective goods under the Polish Civil Code (rękojmia, art. 556–576 Kodeksu cywilnego) where applicable to digital content.
To the maximum extent permitted by law, the Seller's total liability for any claims arising from or related to the Product shall not exceed the amount paid by the Buyer for the Product.
The Seller shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost revenue, or lost advertising spend.
This limitation does not apply to damages caused intentionally or through gross negligence.

The Seller shall respond to the complaint within 14 days of receipt (in accordance with Article 7a of the Polish Consumer Rights Act).

These Terms are governed by the laws of the Republic of Poland. Any disputes arising from these Terms shall be resolved by the competent courts in Poland.
For consumers — in accordance with Article 17 of the Code of Civil Procedure (Kodeks postępowania cywilnego) — the competent court is the court of the consumer's place of residence.
If the Buyer is a consumer within the meaning of Article 22¹ of the Polish Civil Code (Kodeks cywilny), nothing in these Terms limits the Buyer's statutory consumer rights. In case of conflict between these Terms and mandatory consumer protection laws, the statutory provisions shall prevail.
In particular, the Buyer's rights under rękojmia (warranty for defects, art. 556–576 of the Civil Code, as applicable to digital content) are not excluded or limited by these Terms.
The Seller reserves the right to modify these Terms. Updated Terms will be posted on this page with an updated date. Changes do not apply retroactively to contracts concluded before the change.
The Seller will notify Buyers with active Lifetime Updates plans of material changes via the email address provided during purchase.
